Can Foreigners Buy Land and Property in El Salvador? Limits and Requirements

Series: Investing in El Salvador — A legal guide for foreign investors

One of the first questions from anyone considering real estate in El Salvador — a beach house, land for development or an industrial building — is whether foreigners may own property. The short answer is yes, with one constitutional limitation worth understanding before you sign.

The general rule: foreigners may own property

Salvadoran law recognizes foreigners’ right to acquire property, and the Investment Law grants national treatment to foreign investment, subject to legal exceptions. In practice, a foreigner can buy urban property — houses, condominiums, offices, retail space — on the same terms as a Salvadoran, by signing a deed before a notary and registering it with the Real Estate Registry of the CNR.

The exception: rural land and reciprocity

Article 109 of the Constitution provides that rural real estate may not be acquired by foreigners whose home countries do not grant equal rights to Salvadorans. It is a reciprocity rule: if your country allows Salvadorans to buy rural land, you can buy it in El Salvador.

The same provision contains a key exception: the restriction does not apply to land for industrial facilities. The rule also reaches foreign companies and certain Salvadoran companies with majority foreign ownership, so buying through a local company does not always remove the analysis.

Most investors from the United States, Canada, Europe and Latin America come from countries where Salvadorans may acquire property, but each case should be confirmed, especially when the buyer is a company with shareholders of several nationalities.

How to buy safely

  • Full title search: confirm the registered owner, any mortgages, liens or pending annotations, and that the registered description matches the physical property.
  • Property classification: determine whether it is urban or rural and its land-use designation; this affects reciprocity, building permits and project feasibility.
  • Coastal and protected areas: check environmental and land-use restrictions, especially for beach developments.
  • Taxes: the purchase is subject to real estate transfer tax above the statutory threshold, unless an incentive regime exemption applies (for example, tourism or free trade zones).
  • Source of funds: the notary and bank will require documentation of the origin of funds under anti-money-laundering rules.

Frequently asked questions

Do I need residency to buy property?

No. You can buy as a non-resident with your passport. A real estate investment can also support an application for investor residency.

Can I buy without traveling to El Salvador?

Yes, through a special power of attorney signed in your country and apostilled, in favor of an attorney-in-fact who signs the deed on your behalf.

Should I buy personally or through a company?

It depends on the property’s use, your exit plan and the tax burden. For commercial projects, a company often simplifies management and a future sale.
